These Website Standard Terms And Conditions (these “Terms” or these “Website Standard Terms And Conditions”) are contained herein on this webpage, Fenroo.com. shall govern your use of this website, including all pages within this website (collectively referred to herein below as this “Website”). These Terms apply in full force and effect to your use of this Website and by using this Website, you expressly accept all terms and conditions contained herein in full. You must not use this Website if you have any objection to any of these Website Standard Terms And Conditions.

By signing up/registering to this Website, you agree to these Terms.

2. INTELLECTUAL PROPERTY RIGHTS

Other than the content you own, which you may have opted to include on this Website, under these Terms, Fenroo.com own all rights to the intellectual property and material contained in this Website, and all such rights are reserved. You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website.
Fenroo.com is not required to remove, rework, or void any content created by staff or former staff that was submitted to us with the intent of being used as part of the website or services. 
Fenroo.com holds the copyright of any of our images, templates, videos, text, logos, NPCs, and visual assets depicted in derivative works.

Owning a Fenroo.com character means that you hold partial rights to that specific character design. You do not hold ownership over the associated species and you do not hold full rights over the character design, even if you designed it.

Users are allowed to resale characters and their artwork for any currency, but not with NFTs and/or cryptocurrency.
Any Content found on our site may not be used for/or with AI art generators or any other generators.

3. RESTRICTIONS

You are expressly and emphatically restricted from all the following:

1. Selling, sublicensing, and/or otherwise commercializing any Website material digitally and physically.
2. Claiming ownership of any Website material that isn't yours.
3. Using this Website in any way that is, or may be, damaging to this Website.
4. Using this Website in any way that impacts user's access to this Website.
5. Using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or any person or business entity.
6. Engaging in any data mining, data harvesting, data extracting or any other similar activity concerning this Website, or while using this Website.
7. Using this Website to engage in any advertising or marketing unless permission is granted by the admins.
8. Using and finding glitches/bugs to help you advance or gain items that aren't normal or fair. If found, you must alert the glitch/bug to us immediately.

Certain areas of this Website are restricted from access by you and Fenroo.com may further restrict access by you to any areas of this Website, at any time, in its sole and absolute discretion. Any user ID and password you may have for this Website are confidential, and you must maintain the confidentiality of such information.

Purchases and Sales

• 1. All purchases of character designs are conducted outside of this website but may be advertised on or linked to through this service by the staff or users.
• 2. You agree that you are fully responsible and liable for any fees, damages, claims, and losses that result from making purchases from, or selling to, other users found through this website and our community. You agree that you will not hold Fenroo.com or its staff accountable for any fraudulent trades or sales and that we are not required to aid you in your dispute.
• 3. By making purchases of or the sales of character designs for real-life currency, you agree that you and the party you are conducting purchases or sales with are both 18 years or older.
• 4. Fenroo.com makes use of virtual currencies. These currencies cannot be purchased or sold for real-life currency. Fenroo.com virtual currency is only for use on this website to purchase virtual Fenroo.com items or to be exchanged with other users for Fenroo.com items, Fenroo.com character designs, or Fenroo.com-related artwork or writing. Fenroo.com virtual currency cannot be exchanged for any goods or services unrelated to the Fenroo.com website.
• 5. All transactions made with or to obtain virtual currency, items, or characters when going through our virtual shops are final and non-refundable. Staff is not required to reimburse or compensate you in the event of an incorrect or false purchase. Please contact staff if there are any issues with shops or purchases.

4. YOUR CONTENT

In these Website Standard Terms And Conditions, “Your Content” shall mean any audio, video, text, images or other material you choose to display on this Website. Your Content must be your own and must not be infringing on any third party’s rights. Fenroo.com reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.  Your Content must not be generated with any form of AI generator.

Ownership

1. Owning a Fenroo.com character means that you hold partial rights to that specific character design. You do not hold ownership over the associated species and you do not hold full rights over the character design, even if you designed it.
2. Partial rights to a character design means that you hold the ability to do the following:
   1. Transfer the character to another user, as long as you are in line with the character's current transfer limitations.
   2. Use the character on this website and for this website's services.
   3. Make edits to the character design by creating new artwork of the design within the design editing guidelines. All edits must be approved by staff before they are considered official.
   4. Give the character a name and backstory, as long as it is in line with the Terms of Service and character creation guidelines.
   5. Display the original artwork and any artwork depicting the character on this website or in an offsite online gallery if credits to the artist(s) and designer(s) are included.
   6. Create new artwork or writing for the character as long as it is in line with the terms of service.
   7. Commission another artist to create artwork or writing for the character design.
   8. Create "alternate" unofficial character designs based on the character design that are not related to Fenroo.com or its species. (Alternate refers to "AU" or "alternate universe",
   9. meaning a different form of the character not supported by Fenroo.com) All alternate designs are considered likenesses to the original and cannot be transferred separately.
3. By owning a Fenroo.com character you are agreeing that you will not do the following:
   1. Sell a character for real-life currency if it is not able to be sold for real-life currency.
   2. Sell a character above its listed resale price unless granted an exception.
   3. Attempt to sell a character design for real-life currency to anyone under the age of 18
   4. Attempt to sell or transfer a character design to multiple different users at one time.
   5. Trade or exchange a character to another user if it is not able to be traded.
   6. Claiming any artwork or designs as your creation if they were not created by you, or otherwise miscrediting a design or piece of artwork.
   7. Create copies or reproductions of the design or its likeness to be transferred to other users.
   8. Use the character design for commercial purposes.
   9. Mass producing any type of merchandise depicting the character design, reproductions of the character design, or artwork of the character design.
   10. Using a character design for commercial purposes that are not specifically allowed by these terms of service. If you are unsure if the use of a character is considered commercial, please contact the staff.
   11. Use the character design in any way that could be harmful, offensive, obscene, defamatory, or unlawful.
4. All allowed rights to a character design transfer with the character. Any individual trade, resale, or edit restrictions placed on a character by anyone other than staff are not officially supported or enforced by Fenroo.com and do not have to be followed by the owner of that character.
5. The original creator of any character design, artwork, or text has the right to display the content they have created depicting that character design, artwork, or text in their online gallery or portfolio even if they do not hold ownership over the character.
6. A user cannot revoke or void any Fenroo.com character designs they have created, submitted, or previously owned if that design has been transferred to another user. Transfers are done at your own risk, and transfer reversals are done at the discretion of staff we are not required to transfer a character design to you in the event of a fraudulent trade or transaction.
7. Voiding a character design that you currently own must be done with the explicit permission of the original creator of the design. Please contact staff to void a design. Staff is not required to honour any requests to void a character design.
8. In the event of a chargeback on payment for a character design towards any member of staff, we reserve the right to revoke ownership of the character design and regain our original ownership.
9. Failure to abide by ownership terms may have certain rights or all allowed rights to a character revoked from the current owner without prior notice. We will review these on a case-by-case basis.
10. If a user is banned, they will still retain their ownership rights to any Fenroo.com characters they currently own unless those rights have been revoked.
11. If a design is found to contain offensive or harmful material that violates Community Guidelines after approval it must be altered to follow the current up-to-date Community Guidelines at a staff member's request. If changes to the design are not made within 30 days of a staff member sending the notice the user or designer (whichever is applicable) of the character may receive a strike or ban depending on the severity of the content.
12. We do NOT "take back" or "revoke" designs for any reason including if a user has been banned unless that design has not been rightfully obtained, such as not being fully paid for.

5. NO WARRANTIES

This Website is provided “as is,” with all faults, and Fenroo.com makes no express or implied representations or warranties, of any kind, related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consultation or advice to you.

Fenroo.com staff has not reviewed all links present on the site and holds no responsibility for what content linked websites may contain. We do not endorse any content present on websites linked through our service and use of these links is done at the user's own risk.

6. LIMITATION OF LIABILITY

In no event shall Fenroo.com nor any of its officers, directors, staff and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, Fenroo.com including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

7. INDEMNIFICATION

You agree to indemnify, save, and hold harmless Fenroo.com and its staff from any claims, losses, damages, liabilities, attorneys' fees and legal expenses, arising out of your use or misuse of Fenroo.com, any content you post or submit, violation of these Terms, violation of the rights of another third party or entity, or any breach of the representations, warranties, and covenants made by you herein. Fenroo.com reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify Fenroo.com and you agree to cooperate with Fenroo.com's defence of these claims.

You acknowledge that Fenroo.com has no control over, does not endorse, and has no duty to take any action regarding which users gain access to Fenroo.com or its services, what materials you access via Fenroo.com, what effects such materials may have on you, how you interpret or use such materials, or what actions you take as a result of having been exposed to such materials. Fenroo.com may contain links to websites containing content that some people may find inappropriate, harmful, or offensive. You release Fenroo.com from all liability for you having acquired or accessed such materials through this website.

TO THE FULLEST EXTENT BY APPLICABLE LAW: Fenroo.com and services provided through Fenroo.com are provided “as-is” and “as available” without warranties of any kind either implied or expressed. Fenroo.com does not represent or warrant that all content or material on Fenroo.com is complete, error-free, reliable, accurate, or current. You understand and agree that you obtain, view, access, or download any material or data through the use of Fenroo.com at your own risk and that you will be solely responsible for any loss or damages that result from the download of such material or data. You assume the entire cost of any necessary servicing, repair, or correction.

8. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

9. VARIATION OF TERMS

Fenroo.com is permitted to revise these Terms at any time as it sees fit, and by using this Website, you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing the use of this Website.

10. ASSIGNMENT

Fenroo.com shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, .you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11. ENTIRE AGREEMENT

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Fenroo.com and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

12. GOVERNING LAWS & JURISDICTION

These Terms will be governed by and construed in accordance with the laws of the Republic of Ireland, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the Republic of Ireland for the resolution of any disputes.
